PROMPTSWITCH TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using Promptswitch (the "Service"), including our web application and Context Bridge extension, you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. DESCRIPTION OF SERVICE

Promptswitch provides AI prompt enhancement and context-bridging features, including:

  • Web-based prompt enhancement tools
  • Context Bridge browser extension
  • Integrations with third-party services (e.g., Google Drive, Notion, Slack)
  • AI model processing via third-party platforms

3. ACCOUNT ELIGIBILITY AND SECURITY

You must be at least 13 years old to use the Service. You are responsible for:

  • Maintaining secure account credentials
  • All activities under your account
  • Notifying us promptly of unauthorized access

4. ACCEPTABLE USE

You agree not to:

  • Use the Service to access data without authorization
  • Attempt to bypass security controls or access restrictions
  • Use the Service to collect or transfer data for purposes unrelated to the requested feature
  • Engage in activity that violates third-party platform terms

5. CONTEXT BRIDGE SAFETY REQUIREMENTS

The Context Bridge extension is designed for user-initiated use only. You agree that you will:

  • Trigger context access only when you intend to send content for AI assistance
  • Avoid background or automatic data capture
  • Use only the permitted integrations and permissions granted in-context

6. THIRD-PARTY AI PROCESSING

When you request AI enhancement, content may be transmitted to third-party AI providers (for example, ChatGPT or Grok) solely to fulfill your request. You understand that third-party terms apply to their processing.

7. PRIVACY AND DATA USE

Our collection, use, and protection of your data is governed by our Privacy Policy. We follow Google�s Limited Use policy and use data only for the user-requested feature.

8. SERVICE AVAILABILITY

We strive for reliable availability but do not guarantee uninterrupted service. Planned maintenance and unexpected outages may occur.

9. TERMINATION

You may terminate your account at any time. We may suspend or terminate accounts for violations of these Terms or misuse of the Service.

10. BILLING, MERCHANT OF RECORD, AND REFUNDS

Payments for paid plans are processed by Paddle.com Market Ltd, our authorized reseller and Merchant of Record. Your payment statement will reference Paddle. By purchasing a subscription, you agree to Paddle's checkout terms as well as these Terms.

Refunds are governed by our Refund Policy at /refund-policy. In short, we offer refunds for eligible first-time purchases requested within the stated refund window, subject to the criteria in that policy.

11. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. PROMPTSWITCH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Promptswitch is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid in the prior 12 months, or $100 if you have not paid fees.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
